WARNING: This is a legal document that affects your rights
1. The HBF Freeway Bike Hike for Asthma (“the FBHA”) is a bike ride held on 21st March 2010 to raise funds for the Asthma Foundation of WA (“AFWA”).
2. The FBHA is owned by AFWA which licences the management and running of the FBHA to Bluegem Holdings Pty Ltd t/as TriEvents WA (“TriEvents”).
3. By registering to participate in the FBHA you, the undersigned, agree to be bound by these terms and conditions of entry.
4. You acknowledge that it is a requirement of your participation in the FBHA, and you agree, to wear an ANA, ANSI, SNIELL or Australian Standard approved helmet whilst you are participating in the FBHA.
5. You must comply with all of the FBHA rules and regulations, which you will receive with your Participant Pack and are available online (see also www.freewaybikehike.com.au) and you agree to comply with all traffic and road laws and act in accordance with any directions given to you by members of the WA Police Department, ambulance officers, TriEvents and its employees and any officials representing TriEvents.
6. You must, whilst participating in the FBHA, ride safely and responsibly and with consideration for the safety of the other participants, road users, spectators, officials and volunteers.
7. You are responsible for ensuring that you are physically and mentally fit enough to complete the FBHA safely and without risking injury to yourself and other participants in the FBHA and you attest that you have undertaken sufficient training and preparation to complete the FBHA safely and without risking injury to yourself and other participants in the FBHA.
8. You should seek medical advice prior to participating in the FBHA if you have suffered or are suffering from any medical condition which might affect your ability to complete the FBHA safely and without risking injury to yourself and other participants in the FBHA. You must list on the entry form any medical or physical conditions from which you suffer that might affect your ability complete the FBHA safely.
9. You agree and consent to accept medical treatment from TriEvents, any employees or representatives of TriEvents, ambulance officers or medical specialists in the event that you are injured or otherwise become ill or incapacitated during the FBHA. Any medical treatment that you may require will be at your expense.
10. You are responsible for ensuring that your bicycle is in sound mechanical condition to enable you to complete the FBHA safely and without risking injury to yourself and other participants in the FBHA.
11. The FBHA and participation in the FBHA is affected by the weather conditions at the time of the FBHA. You acknowledge that the weather conditions are governed by chance and are not within the control of TriEvents. TriEvents is not liable for any loss, damage, cost or expense suffered or incurred by you as a result, arising out of or connected with the weather conditions.
12. You acknowledge that cycling can be dangerous and involves the real risk of serious injury or even death from matters including, but not limited to, accidents with other road users (whether cyclists or motorists), road and weather conditions and equipment failure.
13. In consideration of AFWA and TriEvents permitting you to participate in the FBHA, you agree to indemnify, hold harmless and release AFWA, TriEvents and their employees, servants and agents, and all officials and volunteers from and against any injury, loss, damage, liability, cost, expense, demand, claim or action whether arising at common law or under statute that you may suffer or incur arising out of or in connection with your participation in the FBHA including as a result of the negligence, breach of statutory duty or any act or omission of AFWA, TriEvents and their employees, servants or agents and all officials and volunteers.
14. The indemnity and release in clause 13 above shall be, and operate separately, in favour of all persons, corporations and organisations involved or otherwise engaged in promoting or staging the FBHA and their servants, agents and representatives including but not limited to the medical and paramedical personnel and police and ambulance officers and the indemnity and release shall operate whether or not the injury, loss, damage, liability, cost, expense, demand, claim or action is attributable to an act or omission or neglect of any one or more of them.
15. You consent to photographs being taken of you before, during and after your participation in the FBHA. You agree and acknowledge that the photographs are owned by TriEvents and that TriEvents may use the photographs for promotional or other purposes without your further consent being obtained. You also consent to TriEvents using your name, image, likeness and your performance in the FBHA, at any time, to promote and publicise the FBHA.
16. If you are under the age of 18yrs at the date of registering your entry:
(a) you confirm that you have obtained the consent of your parent/legal guardian to participate in the FBHA; and
(b) your parent/guardian must complete the consent clause below.
17. You confirm that you will be equal to or above the minimum age on the day of the FBHA for participation in the 60km, 30km or 10km events. The minimum age for participation is; 16yrs for 60km, 12yrs for 30km and 7yrs for the 10km event.
18. You consent to your name being part of a web search on www.freewaybikehike.com.au for fundraising purposes.
19. You understand consent to your personal details being shared with or provided to other parties involved in the FBHA for medical, promotional or statistical purposes.
20. If you are a Group/Team Leader you agree to ensure all members of your team agree to these terms and conditions and you sign on behalf of them.
21. The entry fee is not refundable in any circumstances.
